This website was created to shed light on the gross misconduct and abuse of authority by several officials of the Village of Malverne.  Please understand this does not relate to all village officials.

Malverne is an Incorporated Village in the town of Hempstead. The village is approximently one square mile with the population of about 8,880 in 2008. Malverne became an Incorporated Village on 04/13/1921.

LETTER #2: I SENT THIS LETTER TO CHIEF OF POLICE AND MAYOR ONE YEAR AGO, I STILL DID NOT GET A RESPONSE. HELLO... IS ANYBODY OUT THERE!!! PLEASE READ BELOW

This letter is in regards to the inappropriate and hostile behavior I have received from several officers of the Malverne Police Department.  I am a homeowner living with my wife.  We purchased our home in May of 2005.  Since this time, we have been constantly trying to obtain permits which allow us to park on the street.  We only have a one car garage and we own 3 vehicles which are all registered and insured under my name.  Three motorcycles, one ATV, and a Polaris Ranger, which are all registered and insured, all occupy the garage space at this time.  I ensure you that we do not rent any portion of the home, nor have any other family members living with my wife and I. 

           Somehow, our applications have become “lost” every time we submit them.  We have also been denied a permit to make a section of the side of the house into a driveway.  In the past, we have received numerous citations for parking our vehicles in the street throughout the night, and during this time, simply paid the fines.  I tried to make a formal complaint about the amount of citations I was receiving 2 years ago. After explaining the situation to that officer at the precinct, he began listing several consequences that could result in filing the complaint.  He then asked me if I still wanted to file the complaint.  He was obviously insinuating that if I decided to file the complaint that things would get worse for me.  I ultimately decided not to file the complaint.   

However, we received 6 citations in the last 2 nights.  I proceeded to the Malverne Police station on Wednesday, March 11th at 8:50am to request yet another application to park on the street. The officer at the front desk gave me a form and then asked me why I needed it.  I explained the situation and at that time also requested the name of the officer who issued the summons.  I wanted this information so that I may apologize to this officer in the event that I may have parked in front of his residence or offended him in any way.  I also believe, that the constant citation to just my vehicles, has become some sort of personal vendetta this officer has against me and I want an explanation.  The officer refused to give me the name of the issuing officer as well as his own name. He then said to me, “We don’t want people like you living here.  Why did you move into Malverne?”  I responded saying “I guess I made a mistake.”  This officer then walked away and said to another officer, “This guy’s a fucking asshole,” obviously referring to me. He then proceeded to walk into a back office and slam the door. 

I demand answers as to why we are being treated in such a disrespectful manner.  My wife and I have never done anything to cause disruption in the village.  We are hard working, responsible adults and we do not deserve this type of treatment. What does “people like you” mean?  We are home owners who pay our taxes just like everyone else, as well as make donations to support the various organizations within Malverne.  I help my neighbors and others in the village with snow removal and have never come across any type of hostility with them.  We have invested well over $100,000.00 in renovations to our home and maintain it properly.  We do not deserve to be treated this way, nor does any other hard working, responsible adult.  I believe that some Malverne officers are abusing their authority and we are victims of such behavior and being treated inappropriately. Please understand that the majority of Malverne officers have always shown courtesy, professionalism and respect.  However, the few officers that have acted in such an immature and unfathomable manner reflect poorly on the entire department and taint the image of the truly hard working and respectful officers.

It has cost me up to $120 per day in citations in the event that I or my wife are home from work one day.  We receive citations on 3 vehicles for the No Parking from 3-5am and 1 Hour parking from 6:30am-10am regulations.  We are being treated like commuters who abandon their vehicles on a residential block to board the train. There should be some sort of courtesy for homeowners with no driveway.

What do we do?  I have exhausted all my efforts to obtain permits at this time.  I once believed Malverne was the perfect village to live in and planned to start my family here.  However, with this type of treatment, I am considering otherwise.  I now feel pressured and even threatened by police officers to abandon my home and move out of Malverne in fear of future consequences.  My fears are that one day while I am away on business, my family will not be protected properly and an emergency call will be disregarded.   I have always been under the impression that the officers of an Incorporated Village, especially Malverne, we hired and paid to protect and serve their community.  I was obviously mistaken when this particular officer’s behavior reflected his true intentions which are to run, own, and control the village. 

What “type” of people deserve to live in Malverne?  I am both confused and disgusted and only hope that writing to you can shed some light on this unjustifiable treatment.

I truly apologize that this issue has now come to you, but I have made several attempts over several years to resolve this issue with no success.

I SENT THIS LETTER TO THE MAYOR 2 YEARS AGO, STILL NO ANSWER

To Whom It May Concern:

            I live at the above address; I am having some minor problems regarding tickets that I am receiving on all of my vehicles. I live in a very small house and pay high taxes; however, I understand that the taxes are high because it is in fact a beautiful village.  I live here with my wife and we plan on starting a family.  I would love to raise my kids in a village such as this one. My only problem with this village is the amount of tickets that we receive.  I can’t believe that the police officers in this village give tickets to the hard working people that live here. I understand that there are rules to running an incorporated village, which is why Malverne is such a wonderful place to live. The signs outside my house are for people who park here and take the train. I live here and I think it is very wrong to get a ticket for parking in front of your own house. I also get tickets for parking overnight; I have three vehicles and no driveway.  I filed for a permit to make a driveway and was denied.  I do have a one car garage in which I keep my three motorcycles and one ATV. So please tell me what I am to do with my three vehicles. We are a nice family that pays our taxes and we donate money to various organizations in Malverne. This has been going on for nearly three years and I am tired of paying these tickets. I know there is a parking lot that I could pay to park in; however, money is not the issue. I don’t feel that it is right to have to move my cars in and out of a lot. That’s why I live here and not in Brooklyn…

Please get back to me and hopefully you can somehow help me solve my problem.

 COULD I HAVE BEEN ANY MORE CLEAR AND WILLING?

ALSO KNOW THAT I GAVE IN AND PAID FOR DAY TIME AND OVER NIGHT PASSES FOR THREE VEHICLES, ONE WEEK LATER LETTERS WERE PUT ON MY CAR THAT PASSES WHERE ISSUED IN ERROR AND I COULD NOT PARK THERE. I NEVER GOT ANY MONEY BACK, THEY GAVE ME MORE TICKETS IN RETURN.

 

LETTER #3: I SENT THIS LETTER FOR SHITS AND GIGGLES, THOUGHT MAYBE THEY WOULD GET BACK TO ME IF I GAVE IN.... BUT....HELLO....IS ANYBODY OUT THERE!!!  READ BELOW

 

Please accept this letter as an apology for my recent behavior.  My previous letter was written in anger.  I have spoken to several people in the hopes of gaining some insight into this situation and they have made me realize that I am the one with the wrong attitude.  I moved into this village and therefore should respect any and all regulations that come with living in it.  I have come to understand the reasons behind all of Malverne’s rules and regulations.  Please understand that I did not grow up in a community that had as much concern and commitment to its residents.  It has been difficult for me to adjust to the strict guidelines set in the village without feeling like my freedom has been limited. 

When we first purchased our home, we had an incident with an officer who came to the house one evening when I was having a birthday party for my father.  I have a fireplace in my backyard which was active at the time, and was told by the officer that it was visible from the street and told to extinguish it.  At the time, I did not appreciate the way the officer handled the situation and we had an argument.  After he left, I was infuriated and proceeded to the precinct to file a complaint.  I apologize to that officer for my aggressive behavior.  I understand that he was simply doing his job and trying to protect the safety of the residents as well as mine.

Before making the decision to move into Malverne, I was well aware of the parking rules.  However, I felt that because I was a homeowner, I was entitled to park where I pleased because I do not have sufficient space to keep my vehicles off the street.  I now understand that these parking regulations have been enforced to again protect the residents of Malverne and the image it has long sustained.  The issuing officers were only doing their job and I apologize for ever giving them a hard time for simply following the law that I refused to obey.

The most recent incident was a result of my anger and frustration for receiving multiple summonses.  The previous letter was prematurely written and mostly because of the insult I received by that particular officer at the precinct that morning.  I apologize if it insulted the integrity of the Malverne Police Department and any officials.  Although I still do not completely understand what the officer meant by “people like you”, I believe he was angry and he was referring to the several incidences in which I had refused to follow regulations and perhaps reflected poorly on this community.  I did not realize that my actions could have had such a negative impact on my neighbors as well as law enforcement.

I have since been granted a permit to park my vehicles on the street overnight and I greatly appreciate this.  However, I do wish to completely comply with the parking regulation and take my cars off the street.  If possible, I would like to add a driveway on my property.  Once approved, I will hire an architect and acquire all necessary permits.  Five months ago, I hired an architect because I intend to add a dorma on my home.  My wife and I want to start a family and need more living space to do so. 

As a result of my actions, I feel like I have put my wife and I in a position where we are disliked and I do not want this to cause us to be penalized in any way. I apologize for allowing this situation to escalate and for taking this long to come to the realization that I have been resistant and hostile to change.  I do not wish, in any way, to taint the image of this community and I would be grateful for the opportunity to start over and demonstrate that my family and I deserve to be long term residents of Malverne.
